1. Acceptance of Terms

By registering or bidding, you agree to these terms and any supplemental notices provided at time of auction.

2. Eligibility

Auctions are open to individuals 18 and older. Bids by minors are invalid, and the responsible adult bidder will be held accountable.

3. Auction Type

The Auction Yard operates as a licensed Public Consignment Auction Dealer (PCAD). All items are sold "AS-IS, WHERE-IS, with all faults and without warranty." Vehicles do not come with emissions certification unless stated otherwise.

4. Preview & Inspection

All items, especially vehicles, should be inspected prior to bidding. Inspection reports are not comprehensive. Failure to preview does not waive obligations.

5. Fee Structure

• Vehicles: $175 Admin Fee + 2% (live) or 5% (online) Buyer's Premium
• Equipment: 10% Buyer's Premium
• General Merchandise: 15% Buyer's Premium

6. Bidding Process

All auctions are conducted with reserve unless explicitly stated otherwise. The Auction Yard and its auctioneers reserve the right to bid on behalf of the seller up to the reserve price.

Bids may be revoked prior to auction close by calling our office. Once the auction closes, all bids are final and irrevocable. Tie bids are resolved at the auctioneer's discretion. Bid manipulation or disruptive behavior results in permanent removal.

7. Payment

Full payment is due by the next business day. Accepted methods: cash, wire, or credit card (fees may apply). Sales tax is added unless a valid exemption certificate is provided.

8. Title & Documentation

Titles are held until full payment clears. Vehicles may have branded titles. A $99 seller fee applies per vehicle unless waived.

9. Pickup, Storage, and Abandonment

Items must be removed within 3 business days. Storage fees apply beyond that. After 10 days, items may be considered abandoned.

10. Liability Waiver

Risk transfers to the buyer upon winning bid. The Auction Yard is not liable for damage, theft, or mechanical failure post-sale.

11. Consignment Terms

Consignors must hold legal title. Unsold items must be picked up within 5 days or may be reconsigned or forfeited.

12. Vehicle Disclosures (ARS §28-4410.01)

• No emissions test is required for PCAD sales.
• No implied warranty of merchantability applies.
• The buyer is responsible for post-sale registration and emissions.

13. Dispute Resolution

All disputes will be resolved via binding arbitration in Maricopa County, Arizona. No class actions or jury trials.

14. Code of Conduct

The Auction Yard reserves the right to remove or ban participants for misconduct, non-payment, or abuse.

15. Privacy

Data is used for auction communication only. Personal information is not sold.

16. Updates

Terms may change. Continued use constitutes acceptance of any changes.
