1. Who We Are

The Auction Yard LLC ("The Auction Yard," "we," "us") runs public auctions at 7577 W Mountain View Rd #1, Peoria, AZ 85345 and operates auctionyard.com. This policy explains what personal information we collect through this website and at our auctions, how we use and share it, and the choices you have.

Online bidder registration, bidding, invoicing and online payment take place on online.localauctions.com, which LocalAuctions.com operates under its own privacy policy. LocalAuctions.com shares bidder and buyer information with us so we can run the sale, collect payment and transfer title.

2. Information We Collect

Information you give us. When you submit a consignment request, we collect your name, email, phone number, preferred contact method, and the details and photos of the vehicle, property or items you want to sell. When you bid, buy, consign, call, text or email us, we collect what is needed to complete the transaction, such as your name, address, phone number, email, driver license or other identification, dealer license and tax exemption certificates, payment details, and title, registration and lien information.

Photos and video. We photograph and record items, our lot and our live auctions for listings, records and promotion, including on social media. People at our facility or auctions may appear in these photos and videos.

Disclosure records. When you open a vehicle disclosure, condition report or history report PDF on this site, we record that the disclosure notice was shown and acknowledged, along with your IP address, browser type, the page you came from, the file viewed and the time. We keep these records as proof that disclosures were made before the sale.

Consignor portal. When a consignor signs in, we record sign-in attempts and IP addresses to protect the account.

Device and usage information. If you allow statistics or marketing cookies, Google Analytics and the Meta Pixel collect information about your visit, such as pages viewed, time on the site, the site that referred you, approximate location based on IP address, and browser and device type. See sections 5 and 6.

3. How We Use Information

Respond to consignment requests and questions
Run our auctions, process sales and payments, and transfer titles
Send auction reminders, invoices, payment and pickup notices by email or text
Tell you about upcoming auctions and items you asked about
Document vehicle disclosures and resolve disputes
Keep the website and consignor accounts secure
Measure site traffic and the results of our advertising, if you allow those cookies
Comply with the law and enforce our Terms & Conditions, including collecting unpaid invoices

4. Email and Text Messages

If you give us your email address or mobile number, we may use it to send auction reminders, run lists, invoices, payment and pickup notices, and replies to your questions. We may also send marketing about upcoming auctions by email, and by text to people who agreed to receive marketing texts. We may use a messaging service provider such as Klaviyo to send these messages and to see whether they were opened or clicked.

Every marketing email has an unsubscribe link. To stop text messages, reply STOP. Message and data rates may apply. Consent to marketing texts is not a condition of buying or selling with us. We do not share your mobile number or text messaging consent with third parties for their own marketing.

5. Cookies and Similar Technologies

Cookies are small files a website stores in your browser. On your first visit, a banner lets you accept or reject statistics and marketing cookies. Statistics and marketing cookies stay off unless you accept them. You can change your choice at any time with the Cookie Preferences link at the bottom of every page.

_fbp and fr (marketing, Meta Pixel): measure our Facebook and Instagram ads and show them to past visitors. 90 days. Set only if you accept marketing cookies.
favoriteAuctions (browser storage): saves auctions you star on this site. It stays in your browser and is not sent to us.

6. Analytics and Advertising Partners

Google Analytics helps us understand how visitors use the site. The links below explain how Google uses this information and how to block Google Analytics in your browser.

The Meta Pixel lets us measure our Facebook and Instagram ads and show our ads to people who visited the site. Meta may combine this information with other information it holds about you under its own policies. You can control the ads you see in your Meta account settings.

7. Global Privacy Control and Do Not Track

If your browser sends a Global Privacy Control (GPC) signal, we treat it as a rejection of statistics and marketing cookies, the same as clicking Reject in our banner.

There is no agreed standard for browser Do Not Track signals, so we do not respond to them separately. Use our cookie banner or GPC instead.

8. How We Share Information

We do not sell personal information for money. We share it only as follows:

With LocalAuctions.com, which runs our online bidding platform
With payment processors that handle card and electronic payments
With email and text message providers that send our messages, such as Klaviyo
With service providers that host, secure, translate and deliver this website, such as our web host and Weglot
With Google and Meta through the cookies described above, only if you accept them
With buyers, sellers, lienholders, bankruptcy trustees and government agencies such as the Arizona MVD, when needed to complete a sale or transfer a title
When required by law, subpoena or court order, or to enforce our Terms & Conditions and collect amounts owed
With a buyer of our business, if The Auction Yard is sold or merged

9. California Residents

Under California law, letting the Meta Pixel collect information for ad targeting may count as "sharing" personal information for cross-context behavioral advertising. You can stop it by rejecting marketing cookies or using GPC.

You can ask us what personal information we hold about you, ask us to correct it, or ask us to delete it, subject to records we must keep by law or to complete a sale. We will not treat you differently for making a request. Contact us using the details below.

10. How Long We Keep Information

We keep consignment requests, sale records and title paperwork as long as needed for the sale and for our business, tax and legal records. We keep disclosure records as long as they may be needed to show a disclosure was made. Google Analytics data is kept according to the retention setting in our Google Analytics account.

11. Security

We use reasonable safeguards, including encrypted connections and restricted access to logs and records. No website or system is completely secure.

12. Children

Our auctions are open only to adults 18 and older, and this website is not directed to children. We do not knowingly collect personal information from children under 13.

13. Changes to This Policy

We may update this policy. The date at the top of this page shows when it last changed.
